Non Lucrative Visa

IMPORTANT NOTICE

The new Immigration Regulation (RD 1155/2024) came into effect on May 20th, 2025 introducing significant changes to previous visa procedure. Please note that the content of our web page is for guidance only. Only the legal regulations in force at the time of the visa application submission apply.​

GENERAL INFORMATION

Visa to reside in Spain without carrying out any gainful (work or professional) activity, provided that the applicant has sufficient and guaranteed means to live on. This visa does not constitute a work permit and does not allow any type of work or professional activity, including remotely (online).

The following family members may also obtain the visa: 

  • Spouse, registered partner or duly proven stable partner of the person applying for the residence permit.
  • Minor children, not married or emancipated, of the applicant or his or her spouse, registered partner or stable partner.
  • Adult children of the applicant or his/her spouse, registered partner, or stable partner, who are disabled and require support or who are objectively unable to provide for their own needs due to their health status.
  • Applications for Non-working visas must be submitted in person by appointment only at the BLS Spain Visa Application Center in Washington, D.C.

In order to apply for a Non-working visa at the BLS Spain Visa Application Center in Bangkok. you must be a resident in our jurisdiction (Cambodia, Laos, Myanmar and Thailand)

Please be sure that you have all required documents before scheduling an appointment, as only complete applications with all requirements will be admitted.

PROOF OF RESIDENCE

  • Nationals of Thailand, Myanmar, Cambodia, Laos: No need to submit proof
  • Other nationalities: Must be legal residents in one of the countries above. Submit:
  • Original residence certificate from local authority
  • Copy of visa/residence permit.

TRANSLATION REQUIREMENTS

All documents in a foreign language must be translated into Spanish.  You can find an official translator in Spain here:

  • Foreign official documents must be legalized/apostilled
  • The Embassy may request additional documents or a personal interview.

  • Once issued, the visa must be collected in person at BLS.

"Checklist for Non Lucrative Visa"

Visa to reside in Spain without carrying out any gainful (work or professional) activity, provided that the applicant has sufficient and guaranteed means to live on. This visa does not constitute a work permit.

The following family members may also obtain the visa:

  • Spouse, registered partner or duly proven stable partner of the person applying for the residence permit.
  • Minor children, not married or emancipated, of the applicant or his or her spouse, registered partner or stable partner
  • Adult children of the applicant or his/her spouse, registered partner, or stable partner, who are disabled and require support or who are objectively unable to provide for their own needs due to their health status.

Required documents

1. Each applicant must complete and sign a visa application, filling in each of its sections. If a minor the form must be signed by both parents. (See download form section).

2. Each applicant must complete and sign a copy of the EX-01 form, filling in each of its sections. (See download form section).

3. Photograph. A recent, passport-size, color photograph, taken against a light background, facing forward, without dark or reflective glasses, or any garments concealing the oval of the face

4. Valid, unexpired passport. The original and a photocopy of all pages of the passport must be submitted. The passport must have a minimum validity period of 1 year and contain two blank pages. Passports issued more than 10 years ago will not be accepted.

5. Valid resident permit. Only for non-Thailand, Cambodia, Myanmar and Laos Nationals. Resident permit/visa and certificate of residence issued by authorities of the countries above.

5. Proof of financial means. The applicant must submit the originals and a copy of the documents proving that they have sufficient financial means to cover the expenses of residing in Spain for the initial year of the residence permit, or accrediting that they have a regular source of income, for themselves and, where applicable, for the family members accompanying them. The minimum required amount is equivalent to 400% of Spain's Public Multiple Effects Income Indicator (IPREM). To this amount must be added 100% of the IPREM for each family member in the applicant's care. Foreign documents must be legalized or apostilled and, where applicable, must be submitted together with an official translation into Spanish.

1. - If the accounts or instruments are from outside Spain, all submitted documents must include:

a) The full name or business name of the bank or credit institution, as well as its address, email and phone number.

b) The full identification of the accounts.

c) The opening or closing date, or, where applicable, the dates the authorization was granted and revoked.

d) The account balance as of December 31 of the previous year of application submission and the average balance for the previous year.

The availability of sufficient financial means will be proved by the submission of original and stamped documents that verify the perception of a periodic and sufficient income or the holding of an estate that guarantees the perception of that income.

If the financial means come from shares or participations in Spanish companies, mixed or foreign companies, based in Spain, applicants shall prove, by certification thereof that they do not carry out any work activity in such companies and will submit an affidavit to that effect.

Bank certificates, statements or any other proof of financial means must be duly stamped with the original bank seal, notarized, and apostilled/legalized to provide reliable proof of authenticity.

2. - Last Personal Income Tax Return.

6. Health insurance. Original and a copy of the certificate accrediting the public or private health insurance contracted with an insurance entity authorized to operate in Spain. The insurance policy must cover all the risks insured by Spain's public health system.

7. Criminal record check certificate. Applicants of legal age must submit both the original and a copy of the criminal record check certificate(s) issued by their country or countries of residence for the past 5 years.

This certificate cannot be older than 6 months, unless the certificate itself specifies a longer expiration

Foreign documents must be legalized or apostilled and, where applicable, must be submitted together with an official translation into Spanish.

8. Medical certificate. Original and a copy of a medical certificate accrediting that the applicant does not suffer from any disease that could cause serious repercussions for public health pursuant to the 2005 International Health Regulations. (See download form section. This form doesn’t need translation by sworn translator).

This certificate must be issued within 3 months prior to the date of application by a registered medical practitioner.

The Embassy does not provide information about medical centers that issue this certificate. The applicant may contact any public or private medical Centre duly accredited.

9. Required documents for family members. For each family member it will be necessary to submit:

All the required documents specified in sections 1, 2, 3, 4,5, 6, and 8. For minors, the visa application and the residence permit application must be signed by one of their parents.

Documents constituting proof of family relationship with the applicant accrediting financial means: birth or marriage certificates issued by the civil registry, certificate of registration as an unmarried couple or any other document substantiating an unmarried partnership with the applicant.

In the case of adult children of the applicant or his/her spouse, registered partner, or stable partner, documents proving disability that requires support or proving they are objectively unable to provide for their own needs due to their health status.

Foreign documents must be legalized or apostilled and, where applicable, must be submitted together with an official translation into Spanish.

When necessary to assess the application, the Consular Office may request additional documents or data and may also ask the applicant to come in for a personal interview.

Procedure

This Consular Office is competent to accept visa applications from individuals residing in the consular district.

All non-working residence visas require the obtainment of an initial residence permit, which is processed at the same time as the visa application.

Who can apply for a visa: Visa applications must be submitted in person by the applicant or by one of their parents if the applicant is under a minor.

Place of submission:

Rectifying the application: The Consular Office may ask the applicant to submit any missing documents, or to provide additional documents or data that are necessary for a decision regarding the application. The applicant may also be called in for a personal interview.

Decision period: The legal period for reaching a decision is 3 months from the day after the application submission date, but this period may be extended if an interview or additional documents are requested.

Collecting the visa: The visa must be collected in person by the applicant or by their legal representative (if the applicant is a minor) within a maximum period of 1 month, counted as of the day after the date on which the favorable decision is notified. BLS will inform the applicant regarding the procedure for the return of the passport and any other original documentation.

Refusal of the residence permit or visa: Refusals of the residence permit or visa will always be notified in writing, setting forth the grounds on which the decision adopted was based.

Appeals: If a residence permit or visa is refused, the applicant may submit an appeal for reconsideration to this Consular Office within 1 month of the day following the date on which notification of the refusal is received.

The appeal addressed to the Visa Department must be submitted in person, post or other courier service All documents attached to the appeal must be translated into Spanish.

An application for judicial review may also be filed with the High Court of Justice of Madrid within the 2-month period beginning the day after the date on which the applicant receives notification of the refusal of the visa or residence permit or of the dismissal of the reconsideration appeal.

Validity period of the visa: The visa will be valid for 1 year. Once in Spain, the holder has 1 month to apply for a Foreigner Identity Card, at the Foreign Nationals' Office or the corresponding Police Station.

VERY IMPORTANT!

Submit original and copy of all documents.

All foreign documents must be dully legalized/apostilled except official documents issued by a Member State of the European Union.

All documentation in a foreign language must be translated into Spanish by a sworn translator You may find a sworn translator in Spain here:

The translation made by a sworn translator in Spain don’t need to be legalized/apostilled. Translations sent to the applicant by email are accepted.

Applications accepted at the Spain Visa Application Centre will be submitted on the next working day at the Embassy of Spain/Consulate General of Spain. Once the application has been submitted, the applicant can be further requested additional documentation in support of the same. Please note as per the instructions received from Embassy of Spain minimum processing time is upto 3 months (It may delay depending on case to case).
